1. Scope and Acceptance
Our website is designed to share information about Southwestern Law School (“Southwestern”) and to provide secure, reliable online services to our community and visitors. These Terms of Use describe the rules designed to protect both you and Southwestern when you use our Site.
These Terms of Use (“Terms”) govern your access to and use of the Southwestern website (including all pages and services under the swlaw.edu domain and swlaw.sharepoint.com domain, collectively referred to as the “Site”). By using or participating in this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms apply to all users of the Site, whether or not affiliated with Southwestern, and to all use of the Site from on-campus or remote locations. If you do not agree with any part of these Terms, you must not use this Site. Using the Site is conditioned upon your acceptance of these Terms in their entirety. Southwestern reserves the right to modify or update these Terms at any time as detailed in Section 10 below; continued use of the Site after any changes are posted will constitute your agreement to the revised Terms.
2. Eligibility
You must be at least 13 years of age to use this Site; the Site is not intended for children under 13. If you are under 18 years old, you may use the Site only under the supervision of a parent or legal guardian. By using the Site, you represent and warrant that you meet the applicable age requirements and have the legal capacity and authority to enter into this agreement. You also agree that you are not otherwise barred from using the Site under any applicable laws.
In accordance with 47 U.S.C. section 230(d), Southwestern notifies you that parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to material that could be harmful to minors.
3. Permitted and Prohibited Uses
Permitted Uses: You may use the Site only for lawful purposes consistent with Southwestern’s educational mission and intended functions. Permitted uses of the Site include, but are not limited to:
- Educational and institutional use: Using the Site for legitimate educational, instructional, research, scholarship, or administrative activities related to Southwestern’s programs and operations. This use includes accessing information about academic programs, admissions, career services, and events. It also includes authorized individuals’ (e.g., current students and faculty) use of the Portal for its intended purposes.
- Personal informational use: Viewing, downloading, or printing Site content for your personal, non-commercial use (such as learning about Southwestern, its student and campus activities, or its publications) in a manner that does not infringe Southwestern’s rights or interfere with the Site’s operation. Incidental personal use that is not related to official law school functions is permissible if it is minimal and does not violate other Terms or policies.
- Engagement with services: Applying for admission, paying tuition, registering for classes, registering for events, or otherwise interacting with services and features made available through the Site (e.g., submitting inquiries or forms) for their intended lawful purpose. Authorized users (such as applicants, students, faculty, staff, alumni, or others who have been approved by Southwestern) may access secure areas of the Site (e.g., portal or learning management system) with valid credentials, solely for their intended academic or administrative use.
Prohibited Uses: You agree that you will not engage in any use of the Site that is illegal, improper, or otherwise violates these Terms. Prohibited conduct includes, but is not limited to, the following:
- Unlawful or unauthorized activities: Using the Site for any purpose that violates any applicable law or regulation, or that violates any Southwestern policy. Unlawful or unauthorized activities include, without limitation, engaging in any criminal activity, fraud, or attempting to gain unauthorized access to any accounts, data, or systems of the Site or Southwestern (such as hacking into restricted systems or circumventing access controls).
- Security violations: Attempting to probe, scan, or test the vulnerability of the Site or any related network, or to breach security or authentication measures, except as expressly authorized in writing by Southwestern (e.g., security assessments conducted by or at the direction of Southwestern’s Information Technology department). You may not attempt to circumvent any content-filtering techniques or security features used by Southwestern. Likewise, you must not interfere with or disrupt the proper working of the Site or any servers or networks used to support the Site (e.g., by introducing viruses, worms, Trojan horses, malware, or any other code intended to damage or impair the Site’s functionality).
- Intellectual property misuse: Engaging in any activity that infringes intellectual property rights. This misuse includes unauthorized reproduction, distribution, or display of any content from the Site (such as library materials, Southwestern publications, law review articles, or educational content) in violation of copyright law or license agreements. You are expressly prohibited from copying or posting any Site content on any other website or platform without permission, and from using any content for purposes outside personal fair use or as otherwise permitted by law.
- Commercial or unauthorized use: Using the Site or any Southwestern computing resources for any commercial purpose, advertising, or personal financial gain that Southwestern does not expressly approve. The Site and its content are provided for informational and educational purposes; you may not exploit the Site by selling access to it, by selling or advertising products or services, or by soliciting business, except as part of authorized Southwestern activities.
- Harassment and disruption: Using the Site’s communication tools (such as email links or any future forums/comment sections) to harass, threaten, or spam others. This prohibition includes sending unsolicited bulk emails or communications (“spam”), chain letters, pyramid schemes, or any other form of unwanted solicitation via the Site. You also may not engage in any form of cyber-bullying, intimidation, or repeated unwanted contact through the Site.
- Impersonation and fraudulent content: Misrepresenting your identity or affiliation with any person or entity while using the Site. You must not impersonate any other person (including other students or staff), or falsely state or imply an affiliation with Southwestern if none exists. Additionally, you must not upload, post, or transmit any content that is false, defamatory, fraudulent, obscene, or otherwise unlawful via the Site.
- Discriminatory or harmful material: Posting or displaying any content on the Site (such as in any user-submitted forums or profiles) that is hateful, harassing, or discriminatory towards any individual or group, or that creates an intimidating, hostile, or offensive environment. In particular, content that targets someone on the basis of race, color, sex, gender, sexual orientation, religion, national origin, age, disability, or any other protected characteristic is strictly prohibited.
- Account misuse: Disclosing your Site login credentials (username/password) to any other person or permitting anyone else to access the Site through your account or using another person’s account without authorization. If you have access to secure or portal areas of the Site (e.g., for students or faculty), you are responsible for maintaining the confidentiality of your credentials. Unauthorized sharing of accounts or access is grounds for suspension of privileges.
- Misuse of Southwestern’s name or resources: Using Southwestern’s name, logos, or copyrighted material in a manner that suggests sponsorship, endorsement, or approval by Southwestern without prior written consent. This misuse includes, for example, using the school’s logo on an unofficial website or creating any false association with Southwestern. You are also prohibited from using the Site or Southwestern’s computing resources to host or transmit content that would reflect poorly on or damage the law school’s reputation or operations.
- Other unauthorized activities: Engaging in any other conduct that Southwestern determines, in its sole discretion, is detrimental to the use and enjoyment of the Site by others or that could expose Southwestern to liability or undue risk, including any action that violates the spirit or intent of these Terms, even if not explicitly listed here.
Southwestern reserves the right to suspend or terminate your access to the Site, or to take other appropriate remedial actions, if you engage in any of the prohibited uses listed above. Activities that violate these Terms may also result in referral to appropriate law enforcement or regulatory authorities and/or disciplinary action (if you are a Southwestern student or employee), as applicable.
4. Intellectual Property
All content and materials available on the Site are the intellectual property of Southwestern or other parties and are protected by copyright, trademark, and other applicable intellectual property laws. Content and materials include, without limitation, the text, images, graphics, photographs, video and audio content, design and layout, databases, software code, and any publications or educational materials provided on the Site. Southwestern retains all rights, title, and interest in and to the Site content, and all such content is provided to you for personal, non-commercial, and lawful use only. Except as expressly permitted by Southwestern or by law, you may not copy, reproduce, distribute, publicly display, perform, publish, license, create derivative works from, or otherwise exploit any portion of the Site’s content. Any unauthorized use of Site content may violate copyright laws, trademark laws, privacy and publicity laws, and other regulations. Southwestern will aggressively enforce its intellectual property rights to the full extent of the law. If you are a student or employee of Southwestern, you are also expected to comply with institutional policies on copyright and acceptable use when using Site materials. Furthermore, Southwestern respects the intellectual property rights of others; if you believe that any material on the Site infringes your copyright, please notify our designated agent as outlined below, and we will respond in accordance with the Digital Millennium Copyright Act (DMCA).
Southwestern’s names, logos, seals, insignia, and all related graphics or branding on the Site are trademarks or service marks of Southwestern Law School. All trademarks, service marks, and trade names, including the Southwestern name and logo, are owned by Southwestern and are protected by law. You are not permitted to use Southwestern’s marks in any manner (such as in marketing, advertising, or on other websites) without prior written permission from Southwestern. Any unauthorized use of these trademarks—including any use that is likely to cause confusion or imply endorsement, affiliation, or sponsorship by Southwestern—is strictly prohibited. All other trademarks or service marks that appear on the Site are the property of their respective owners and are used on the Site merely for identification or informational purposes. Their use on the Site does not imply any affiliation with or endorsement by Southwestern.
DMCA Designated Agent: In accordance with the DMCA, Southwestern has designated an agent to receive notices of claimed copyright infringement related to the Site. Your notice must comply with the requirements of 17 U.S.C. section 512(c)(3). For more details on the required contents of a proper notice, you may refer to Southwestern’s Website Copyright Infringement policy or the text of the DMCA. Southwestern will review and address all valid DMCA notices and may remove or disable access to allegedly infringing material in accordance with the law. Please note that if you knowingly misrepresent that the content on the Site is infringing, you may be liable for damages. Counter notifications by alleged infringers may be submitted pursuant to 17 U.S.C. section 512(g)(3) if you believe content was removed due to an error or misidentification.
5. User-Submitted Information
Certain features of the Site, such as contact forms (to request information or ask questions), application or registration forms, event sign-ups, or other interactive features, may allow you to submit information to Southwestern. By submitting or transmitting any information, content, or materials through the Site (“User Submissions”), you grant Southwestern a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and process those submissions for the purposes for which you provided them and for Southwestern’s legitimate administrative, educational, or marketing purposes, in accordance with applicable law and Southwestern’s Online Privacy Policy. For example, if you submit personal information to inquire about admissions or academic programs, you consent to Southwestern using that information to contact you about educational opportunities, to send you newsletters or updates, and to otherwise follow up on your inquiry or “lead” regarding admissions. Similarly, if you fill out an application or provide data for event registration, Southwestern may use your information to process that application or registration and to communicate with you about related matters.
You agree that any information you provide will be truthful, accurate, and submitted in good faith. You must not submit the personal data of others without proper authority or consent, nor any content that is illegal, defamatory, infringing, or in violation of these Terms. User Submissions containing sensitive personal information (such as Social Security numbers, financial account details, etc.) should be submitted only through secure, designated channels and only when requested by Southwestern for official purposes. Any personal information you provide will be handled in accordance with Southwestern’s Online Privacy Policy and applicable privacy laws. Southwestern’s online forms and systems employ reasonable security measures to protect your data, but no system is perfectly secure; by submitting information, you acknowledge this risk.
Southwestern does not claim ownership of content that you submit (such as comments or feedback). However, by providing any User Submission, you acknowledge that Southwestern may copy, modify, and use it as reasonably necessary for the purpose for which you provided it. In addition, you waive any claims against Southwestern for any inadvertent use or disclosure of any ideas or information contained in your submission. If you submit feedback or suggestions about the Site or Southwestern’s services, Southwestern is free to use that feedback for any purpose without obligation to you.
Monitoring and Removing User Submissions: Southwestern reserves the right (but has no obligation) to monitor any user-generated content or communications on the Site and to edit, remove, or refuse to post any User Submission that it deems, in its sole discretion, to be objectionable or in violation of these Terms. This reserved right means, for instance, that Southwestern may review forum posts, comments, or other content you provide and remove content that contains profanity, harassment, advertisements, or anything not in compliance with Section 3 above. Southwestern may also disable your ability to make further submissions if you violate these Terms.
Furthermore, Southwestern reserves the right to disclose any User Submissions or other information as necessary to satisfy any law, regulation, or governmental request, or to protect Southwestern’s rights or the rights and safety of others. For example, if required by a valid subpoena or if there is an emergency involving potential harm, Southwestern may provide relevant information to the authorities. There is no expectation of privacy in any content you submit through public areas of the Site. (For information on how Southwestern collects and manages personal information you submit, please see the Online Privacy Policy referenced below.) By using the Site and submitting information, you acknowledge and agree that Southwestern can collect, use, and disclose your information as described in these Terms and the Online Privacy Policy.
If you are a prospective or current student, be aware that any personal data provided to Southwestern via this Site may also be subject to educational privacy laws (such as the Family Educational Rights and Privacy Act (FERPA)) and Southwestern’s related policies. The Online Privacy Policy provides more details on these protections. User Submissions for employment opportunities (such as resumes or job applications) may be subject to additional terms or notices provided at the submission portal.
6. Privacy and Tracking
Southwestern takes your privacy seriously. We do not sell your personal information, and we use reasonable safeguards designed to protect it in accordance with applicable law and our Online Privacy Policy. We collect and use information only for legitimate institutional purposes, such as providing services, improving our website, and communicating with you about Southwestern programs and activities.
By using this Site, you acknowledge and consent to Southwestern’s use of cookies, analytics, and other tracking technologies that collect information about your visit for purposes such as improving the Site, facilitating admissions outreach, and analyzing user experience, as described in our Online Privacy Policy. If you do not consent to this tracking or data collection, please stop using the Site or adjust your browser settings accordingly, noting that some functionality may be lost.
The Site uses “cookies,” which are small text files placed on your device, to enhance your experience. For example, cookies enable us to recognize your browser, remember your preferences, and keep you logged in to secured portions of the Site. Some cookies are essential for certain features to function (for instance, if the Site has a shopping cart or a login session, cookies keep track of those sessions). At this time, the Site does not respond to “Do Not Track” browser signals, due to the lack of a consistent industry standard. If you activate a Do Not Track setting, we will treat it according to our standard cookie handling practices as described above.
7. Third-Party Content and Links
The Site may contain links or references to third-party websites or resources (e.g., external scholarship websites, legal resources, social media pages, or news articles) provided for your convenience or informational purposes. These sites are owned and operated by third parties, not Southwestern, and Southwestern does not endorse, guarantee, or assume responsibility for their content, accuracy, completeness, legality, or any products or services offered. If you choose to access a third-party site via our Site, you do so at your own risk.
When you follow a link to an external website, you should be aware that you are leaving Southwestern’s Site and that these Terms (and our Online Privacy Policy) will no longer apply. Third-party websites are governed by their own terms of use and privacy policies, which we encourage you to review. Southwestern is not responsible for the privacy practices or any other practices of those external sites. If a third-party site collects data or uses cookies through their link on our Site (e.g., an embedded video from a third-party platform), that data collection is subject to the third party’s policies, not Southwestern’s.
Additionally, any opinions, advice, statements, or other information made available by third parties (including guest speakers, commentators, or external authors) on our Site or via linked sites are solely those of the respective authors and not of Southwestern. Southwestern does not guarantee the validity or reliability of any third-party advice or information on the Site. You assume all risk when accessing third-party content. Southwestern will not be liable for any damages or issues arising from content provided by or actions of any third-party, even if linked from our Site.
If you believe we have linked to a website with inappropriate or harmful content, or if you have any concerns about external links on our Site, please notify the Communications & Marketing department (contact information is provided in Section 12 of these Terms). Southwestern may, at its discretion, remove or disable links to any third-party site that is found to be problematic or out-of-date, but we are under no obligation to monitor or update third-party links.
8. Disclaimer of Legal Advice
The materials and information presented on the Site are provided for general informational, educational, and promotional purposes only. Nothing on this Site constitutes or should be construed as legal advice, nor is it a substitute for professional legal counsel. Although Southwestern is an institution dedicated to legal education, and the Site may contain articles, research, or resources concerning legal topics, no attorney-client relationship is created between you (the user) and Southwestern or its faculty, staff, or students by your use of the Site. The content on the Site may discuss legal issues in a scholarly or general manner, but it is not tailored to any specific situation and should not be relied upon as legal advice. If you require legal advice or representation, you should consult a qualified attorney licensed in your jurisdiction.
Southwestern is not a law firm, and operating this Site (including communications through the Site) is not an invitation to form an attorney-client relationship. Sending emails to individuals at Southwestern (e.g., to professors or clinic attorneys via a contact link) or submitting information through the Site does not create any confidential or privileged relationship. 9. Disclaimers and Limitation of Liability
Disclaimer of Warranties: The Site and all information, content, services, and features made available through it are provided on an “as is” and “as available” basis. Southwestern disclaims all warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Southwestern does not warrant or guarantee that the Site’s content is accurate, complete, or up to date. In particular, while we endeavor to maintain an error-free and secure environment, Southwestern makes no warranty that the Site will operate uninterrupted or error-free, that defects will be corrected, or that the Site or the servers that make it available will always be free of viruses or other harmful components. Any material downloaded or otherwise obtained through the use of the Site is done at your own discretion and risk. You are solely responsible for any damage to your computer system or loss of data that results from the download of any such material. No advice or information, whether oral or written, obtained by you from Southwestern or through the Site, will create any warranty not expressly stated in these Terms. Limitation of Liability: To the fullest extent permitted by applicable law, Southwestern (including its trustees, officers, employees, faculty, students, affiliates, and agents) will not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in any way relating to your access to or use of (or inability to use) the Site or any information contained on the Site. This limitation of liability applies to all causes of action, whether based on contract, tort (including negligence), strict liability, or any other legal theory, even if Southwestern has been advised of the possibility of such damages. In particular, Southwestern will not be liable for any conduct of other users or third parties on the Site, including any defamatory, offensive, or illegal acts or postings by such parties, and the risk of harm or damage from the foregoing rests entirely with you as the user. If you are dissatisfied with the Site, any content on it, or these Terms, your sole and exclusive remedy is to discontinue using the Site.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities. To the extent that such laws apply to you, some of the exclusions or limitations above may not apply. In such cases, Southwestern’s liability will be limited to the maximum extent permitted by law. Nothing in these Terms is intended to exclude or limit any condition, warranty, right, or liability which may not be lawfully excluded or limited. For example, this disclaimer of liability is not intended to circumvent any liability that cannot be excluded under California law, including liability for personal injury or death resulting from Southwestern’s negligence to the extent such liability is mandatorily imposed by law.
Indemnification: You agree to indemnify and hold harmless Southwestern and its officers, employees, and agents from and against any and all claims, damages, liabilities, losses, or expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Site, your violation of these Terms, or your violation of any third party’s rights. Southwestern reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you agree to cooperate with Southwestern in defending such claim.
No oral or written information or advice given by Southwestern or its authorized representatives will create any warranty, and you may not rely on any such information or advice.
10. Modification of Terms
Southwestern reserves the right to change, modify, add, or remove portions of these Terms of Use at any time in its sole discretion. Notice of modifications may be given by posting the updated Terms on this page with a new “Last Updated” date, or by other reasonable means. It is your responsibility to review these Terms periodically for changes. All changes are effective immediately when posted, unless a later effective date is specified. Your continued access or use of the Site following the posting of any changes to the Terms will constitute your acceptance of those changes and agreement to be bound by the revised Terms. If you do not agree to any updated Terms, you must stop using the Site.
For significant changes, Southwestern may (but is not obligated to) place a notice on the Site or send an email notification, to the extent we have your contact information, informing users of the update. However, regardless of whether additional notice is provided, the updated Terms will be binding once posted. We therefore encourage you to check this page regularly to ensure you are familiar with the current version of the Terms.
Please note that other websites or online services operated by Southwestern, including program-specific sites, official social media pages, and online storefronts, or third-party services linked through our Site, may have their own terms and conditions. Examples of these other websites or online services may include fundraising platforms, e-commerce sites, and social media channels. Changes to those terms will be handled as specified on those respective sites.
Southwestern also reserves the right to modify or discontinue any portion of the Site or any services or features provided through the Site at any time, temporarily or permanently, without notice. Southwestern will not be liable if, for any reason, all or any part of the Site is unavailable at any time or for any period. We may restrict access to some parts of the Site, or the entire Site, to users, including registered users, from time to time.
11. Governing Law and Jurisdiction
This Terms of Use agreement and your use of the Site will be governed by and construed in accordance with the laws of the State of California, U.S.A., without regard to its conflict of law principles. These Terms are entered into in the State of California, and California’s substantive laws will apply to any dispute or claim arising out of or relating to your use of the Site or to these Terms, regardless of your location. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms.
You further agree that any dispute, claim, or cause of action arising out of or in connection with these Terms or your use of the Site will be exclusively brought in the appropriate courts of the State of California or the federal court for the Central District of California. Venue for any proceedings will lie in Los Angeles County, California, which is where Southwestern is located and where the Site is hosted. You expressly consent and submit to the personal jurisdiction of said courts for the purpose of litigating any such dispute. You also waive any objections to the convenience of this forum (forum non conveniens) or to the jurisdiction of these courts.
Notwithstanding the foregoing, Southwestern retains the right to seek injunctive or equitable relief in any jurisdiction to prevent unauthorized use of its intellectual property or confidential information.
International Users: The Site is controlled and operated by Southwestern from California. Southwestern makes no representation that the content is appropriate or available for use in other locations. 12. Additional Terms

Headings: Section headings and summaries in these Terms are for convenience only and have no legal or contractual effect. They do not limit or define the scope of any section.
Termination: Southwestern reserves the right, in its sole discretion, to terminate or suspend your access to all or part of the Site for any reason, including without limitation any violation of these Terms. In the event of termination, the proprietary rights, disclaimer of warranties, indemnities, limitations of liability, and governing law provisions set forth in these Terms will survive.
